The decision of the High Court regarding the post of General Secretary of Bangladesh Film Artists Association has been postponed

The Chamber Court of the Appellate Division of the Bangladesh Supreme Court has stayed the verdict of the High Court on the validity of the candidature of film actor Zayed Khan for the post of General Secretary of the Bangladesh Film Artists Association.
The chamber court of Justice Obaidul Hasan on Sunday (March 6th) adjourned the hearing of the High Court's verdict for four weeks after hearing an appeal filed by actress Nipun Akter against the High Court's verdict. At the same time, the court has ordered to maintain the status quo (Statusco). As a result, Zayed Khan, who took the oath of office, will be able to continue his duties, his lawyer said.
Lawyers Ahsanul Karim and Nahid Sultana Yuthi were present in the court hearing on behalf of Zayed Khan. Barrister Rokon Uddin Mahmud and Barrister Mostafizur Rahman were in favor of Nipun.
Earlier, on March 2, the High Court ruled that the Electoral Appeal Board had declared Nipun Akhtar as the uncontested winner and Zayed Khan's candidature for the post of General Secretary was valid.
As a result of the judgment of the High Court bench of Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman, the post of General Secretary of Bangladesh Film Artists Association was won by Zayed Khan.
It may be mentioned that the Chief Election Commissioner Peerzada Shahidul Harun announced the results at the FDC on Saturday morning after the voting for the 2022-24 term of the Film Artists Association was held on January 26. Ilyas Kanchan defeated Misha Saudagar, who was the president of Shilpi Samiti for the last two terms, by 43 votes. Nipun Akter, the candidate of Ilyas Kanchan's panel, lost to Zayed Khan by 13 votes.
However, Nipun filed a petition in the Electoral Appeal Board seeking cancellation of the posts of Zayed Khan and Chunnu, a member of the executive council, alleging that they had bought votes with money. The Department of Social Services sent a letter to the Electoral Appeal Board to decide on the application.
Then the Electoral Appeal Board of Bangladesh Film Artists Association sat in a meeting on Zayed Khan and Chunnu. After the meeting, Sohanur Rahman, the head of the board and a filmmaker, rejected the candidature of Sohan Zayed and declared Nipun as the uncontested winner. The day after the announcement, Elias Kanchan and the winners of Nipun Parishad took oath.
Zayed Khan filed a writ petition in the High Court challenging the validity of the decision to declare Nipunh as uncontested winner and cancel his candidature. Following the hearing of the writ petition, the High Court bench of Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman stayed the decision of the Electoral Appeal Board of the Bangladesh Film Artists Association to reject Zayed Khan's candidature. At the same time, Zaid Khan's candidature was rejected and Nipun was declared the winner. In addition, the effect of the letter of the Department of Social Services to the Electoral Appeal Board to decide on the allegations of Nipun was also suspended.
Nipun appealed to the Appellate Division against the order of the High Court. A full bench of the Appellate Division, hearing the appeal, directed the High Court to dispose of the rule issued by them. However, the High Court was asked to maintain the status quo of the post of General Secretary till the rule is decided. Accordingly, on March 2, the High Court ruled in favor of Zayed Khan. After the verdict, Zayed Khan was sworn in as the general secretary of Shilpi Samiti.
